Abstract
It is the responsibility of state to fulfill the economic, social, and cultural rights. In doing so, the state should respect, protect, and fulfill. The responsibility of state to respect is an essential negative duty to self-restrain from doing. Whereas to protect and to fulfill are positive responsibility to protect individual from real act from the third party. and provide/facilitate service to every citizens. This paper shows that that rights does not only consist of positive duty to be fulfilled by state, it also does consist of the duty to provide and facilitate services related to children rights, and respect and protect that rights.
