Abstract
This thesis was made in purposed to analyse hp as a military soldier Second Private rank who did not attend the border post for security duty without permission due to suspected temporary mental disorder should or not be subject to criminal responsibility reviewed from the 1997 constitution number 31 about the military justice and the criminal military law code. The results showed that hp cannot be charged responsibility crime because hp did “not attend without permission” when he had suspected of temporary mental disorder. Although hp fulfill elements from article 86 to-1 based the criminal military law code but a criminal offense is suspected that a mental disorder that hp cannot be charged and take criminal responsibility because hp have an opportunity pardoning contained in article paragraph 44 verse (1) book the act of criminal law. Based on the 1997 constitution number 31 about the military justice a trial to hp, military prosecuting attorney proposed cassation was preprocessed well and correctly. The right verdict for HP is out of all lawsuits (ontslag van alle rechtsvervolging).
