Abstract

Abstract  Environmental damage cannot be separated from human actions in managing and utilizing the environment. Environmental damage done by humans without regard to the function of the environment can cause environmental and ecosystem imbalances in it. The case analysis of sea sand mining carried out by A which causes environmental damage aims to find out whether A which conducts sea sand mining that causes environmental damage can be subject to criminal compliance in accordance with Article 73 letter d of Law Number 27 of 2007 concerning Management of Coastal Areas and Small island. A action that carries out sea sand mining which causes environmental damage has complied with Article 73 letter d of the Law on Management of Coastal Areas and small islands. Sea Sand mining carried out by A has caused environmental damage and caused losses to the country. A can be liable because it fulfills the elements of criminal liability. First, action A which causes environmental damage is a criminal act that violates Article 73 letter d of Law Number 27 of 2007 concerning Management of Coastal Areas and Small Islands. Second, A is an adult and knows and wants his actions to be inappropriate. Third, A has one form of error, namely intentionally due to A consciously and knowing that the mine must have permission and as miners must pay attention to how it works so that it does not cause environmental damage or loss to the state.
