Abstract
This paper discusses the bill of the Indonesian Criminal Code. This paper assumes that the criminal code serves as the guidance of citizens of a state so that they could live peacefully and orderly, because those who behave contradictory to the criminal code will be punish for their misbehaves. The next criminal code should be based on the people needs, civil liberties, and human rights. Otherwise, the new penal code will only serve the government interests on the expense of its people. The making of the new criminal code should be shaped by five important values: equality, freedom, solidarity, subsidiarity, and public interests. This paper suggests that the criminalisations stated in the bill should be carefully critisized on the basis of democratic norms and values.
