Abstract

The right to education becomes important as the Government issued a policy to work from home (WFH)/study from home (SFH). This article aims to explain the importance of the right to education in the Covid-19 pandemic, which is closely related to the right to information from the use of internet. Violation of the right to education is also associated with the application of the criminal law properly in order to be effective. Normative juridical research methods on legal provisions in the field of Human Rights and international legal instruments place the right to information as an important part of the right to education. The results, the guarantee and protection of the right to education as well as the right to information need to be carried out in a planned manner even during the pandemic. The construction of the right to education is closely related to the right to information as two sides of a coin during the Covid-19 pandemic. The use of criminal law must not be arbitrary. Criminal sanctions are applied ultimum remidium for any violations that occur. Efforts to promote the fulfillment of the right to education take precedence over the punishment of perpetrators.
