Abstract
Indonesia has acceded to the Apostille Convention with the issuance of Presidential Regulation Number 2 of 2021, for this action, Indonesia is subject to all the rules in the Apostille Convention. One of them is about the legalization of foreign documents. The process of legalizing foreign documents, which used to go through a complicated process and go through many government institutions such as the Ministry of Law and Human Rights and the Ministry of Foreign Affairs, was later changed using Apostille Certificated. Currently, the Government of Indonesia has not determined the “authorized authority” that will carry out the Apostille Certificate process. This study aims to discuss the use of Apostille Certificated for public documents in accordance with the Apostille Convention applicable in Indonesia, and compare the use of Apostille Certificated in other countries. This research was conducted using the juridical-normative method, by including several examples from other countries that are relevant to the discussion. Apostille Certificated in fact provides a very large advantage for Indonesia, to encourage international investment interest and make it easier for every individual in the convention member countries, especially those requiring recognition of the legality of cross-border documents.
