Abstract

In the loan agreement that is bound by the agreement, namely the party who lent or the creditor with the borrower, namely the debtor, the form of achievement is that the party who lends submits a certain amount of money as the object of the agreement and the borrower has the obligation to return the loan in accordance with the time specified or agreed upon in the agreement. loan agreement. There is a legal relationship based on a loan agreement made in the form of a debt acknowledgment deed by submitting an object as collateral in the form of a parcel of land. When the debtor as the borrower is unable to repay the loan, the creditor takes steps before a notary to make a PPJB deed, the deed is signed by the parties, namely the borrower. The problems discussed are whether PPJB made before a notary is subject to sanctions by the Regional Supervisory Council which is used as the basis for creditors to control land parcels as collateral objects that have binding force and whether legal protection for debtors whose collateral objects are transferred based on the PPJB deed made before a notary. It is concluded that the PPJB made before a notary is subject to sanctions by the Regional Supervisory Council, and the plot of land used as the object of sale and purchase is used as the basis for the creditor to control the plot of land as the object of collateral. The PPJB deed has no binding force contrary to the provisions of Article 12 UUHT. The debtor as the owner of the land as the object of the debt guarantee, is made an object of PPJB and the power to sell is harmed, has the right to obtain legal protection by suing a notary on the basis of having committed an unlawful act as stipulated in Article 1365 of the Civil Code with reimbursement of costs, losses and interest
