Abstract

In the digital era, consumers are transforming into new entities such as influencers, YouTubers, or content bloggers who bring changes in the form of conveying consumer opinions and complaints in the form of content that can be monetized. This phenomenon cannot be fully accommodated by the Consumer Protection Law because the consumers referred to by the law are end users whose consumption activities are not for commercial purposes. Thus, reviews from consumers who are also influencers, YouTubers, and content bloggers may not receive legal protection. This becomes even more problematic with the presence of several bad precedents in the form of defamation lawsuits brought by business actors against consumers as well as influencers who submit reviews on social media. This research aims to answer the distortion of consumers' position regarding the right to be heard in the digital era, both their legal standing as end users and the content they create as influencers. This paper is a normative juridical writing, where the method in this research is a literature study of both primary and secondary legal materials. Lex consumen derogate legi consumte principle can be used to see the particular legal standing in providing legal protection for consumer reviews. Consumers who provide reviews on social media still obtain legal protection under the Consumer Protection Law as long as the review is based on their transaction experience in consumption activities and not just purely commercial content interests.
