Abstract

This study aims to analyze the legal aspects of donation-based crowdfunding practices in Indonesia and to assess the effectiveness of the existing regulatory and frameworks and oversight. Donation-based crowdfunding refers to an internet-based fundraising mechanism commonly utilized to support social and humanitarian initiatives. Although donation activities are regulated under several legal instruments, current regulations do not specifically address the unique characteristics of donation practices conducted through digital platforms. As a result, these practices are vulnerable to various issues, including the misuse of donated funds, discrepancies between program implementation and promised outcomes, unlicensed fundraising activities, and fraudulent schemes disguised as charitable initiatives. This research employs a normative juridical method, using statutory and conceptual approaches. The findings underscore the importance of comprehensive oversight of all parties involved in donation-based crowdfunding practices, as well as the need for inter-agency synergy to foster a secure, transparent, and accountable digital fundraising ecosystem. These findings are expected to contributes to the development of legal policies that are more responsive to the evolving dynamics of digital fundraising in Indonesia.
