Abstract

Technological advancements have significantly transformed various aspects of human life, including transportation sector. One such innovations is the emergence of app-based motorcycle taxi services, commonly known as online motorcycle taxis, which offer convenience to the public. However, these services face legal challenges due to the lack of explicit recognition as public transportation under Law Number 22 of 2009 concerning Road Traffic and Transportation. This study aims to analyze the legal status and protection of online motorcycle taxis from the perspective of transportation law in Indonesia. The research employs a normative juridical approach and literature study. The findings reveal that although online motorcycle taxis fullfill the characteristics of transportation services, their legal status remains ambiguous as motorcycles are not classified as public transportation vehicles. Minister of Transportation Regulation Number 12 of 2019 provides an operational and legal framework for their existence, yet more comprehensive regulation is required to ensure legal certainty and protection.
