Abstract

Femicide is addressed as one of the extreme trends of Gender-based Violence. The United Nations Office on Drugs and Crimes 2022 explained that gender inequality, unequal power dynamics, and detrimental social norms all contribute to Violence against women and girls, which is a severe violation of human rights. National Woman Commission of the Republic of Indonesia (so-called Komnas Perempuan), in their report on 2021, started the report by saying that Femicide is not recognised in the national or local laws of Indonesia, as well as in the data collection related to the murder of women at the Criminal Investigation Agency (Bareskrim) Police of the Republic of Indonesia. Cases of murder against women are handled as criminal offences in general. Therefore, disaggregated data on female homicide is not available at Bareskrim. Komnas Perempuan categorises Femicide based on the intent of the killing into two types: (1) direct Femicide and (2) indirect Femicide. Indonesian Legal Framework cannot be directed to be explicitly forced to the case of Femicide in Indonesia. However, Indonesian Laws and regulations may have perspectives in it. Komnas Perempuan, in their early analysis and working paper, encourages the integration of Femicide cases for national policy advocacy, urging stakeholders to follow recommendations for violence elimination, victim justice and safe places. This paper needs to examine how the judicial proceedings and non-judicial proceedings in Indonesia handle the cases of Femicide. The role of education and willingness to reconstruct the laws of gender-based violation for Femicide cases as the hypothesis.
