Abstract

This research is motivated by the continuing strength of adat law in resolving land disputes amidst the dominance of national law. Land disputes in the village are generally settled through non-litigation mechanisms based on adat law, which are considered effective and capable of maintaining social harmony. This study aims to analyze the implementation of adat law, and its effectiveness in resolving land disputes. This research employs an empirical normative juridical method, combining a normative approach that focuses on positive law and applicable legal norms with an empirical approach that examines the implementation of law within community life. Data were collected through in-depth interviews with customary leaders, the village head, and parties involved in land disputes, participant observation, and document analysis. The collected data were analyzed through data reduction, data presentation, and conclusion drawing. The findings reveal that the application of adat law follows an established procedure, beginning with mediation by family elders, followed by intervention from customary leaders, and ultimately through customary deliberation led by the customary chief. Customary law emphasizes restorative principles and the restoration of kinship relationships rather than legal sanctions alone. The main supporting factors include the authority of customary leaders, and strong kinship values. However, its implementation faces challenges, including the influence of national law, conflicts involving land certificates, and the younger generation’s declining understanding of customary traditions. Nevertheless, adat law remains highly effective because it produces resolutions accepted by all parties, is and prevents prolonged conflicts, thereby preserving social cohesion and community integrity.
