Abstract

Real Person Fictions (RPF) are works of fiction that emphasize the character using real people, especially public figures as the characters in the author’s work. One embodiment of RPF is the RPF online novel. Because RPF use public figures as the characters, the author also uses portraits and personal identities of that public figure. This author’s actions will cause harm to that public figure and the photographer, especially if done without permission. Self portraits in Article 40 Paragraph (1) Letter l of Undang-Undang Nomor 28 Tahun 2014tentang Hak Ciptaare included as works protected by copyright, while personal identities are included as part of personal data, where personal data is regulated in Undang-Undang Nomor 27 Tahun 2022tentang Pelindungan Data Pribadi. This research aims to find the appropriate form of legal protection for the photographer and public figures from these two regulations, both preventive and repressive. Therefore, this research uses a normative juridical method by looking at that two regulations as the main references. Preventive legal protection based on Article 9 Paragraph (1) until Paragraph (2) of Undang-Undang Hak Cipta and Article 16 Paragraph (2) of Undang-Undang Pelindungan Data Pribadi and repressively by filling a lawsuit for damages.Keywords:Real Person Fiction; Legal Protection; Portrait; Personal Identity
