Abstract

This study aims to analyze the conformity of legal protection for elderly beneficiaries of the Family Hope Program (Program Keluarga Harapan/PKH) social assistance with the applicable laws and regulations, as well as to analyze the implementation of the Family Hope Program (PKH) for the elderly from the perspective of social welfare. This study employs a normative juridical research method using statutory and conceptual approaches. The legal materials consist of primary and secondary legal materials, which are analyzed qualitatively using Philipus M. Hadjon's Theory of Legal Protection and Richard M. Titmuss's Social Welfare Theory as the analytical framework. The findings indicate that, normatively, legal protection for elderly PKH beneficiaries has an adequate legal basis and is generally in accordance with the applicable laws and regulations. However, Minister of Social Affairs Regulation Number 1 of 2018 concerning the Family Hope Program has not yet provided specific protection for elderly beneficiaries who experience limitations in independently accessing social assistance, thereby creating the potential for dependence on other parties and the misuse of social assistance. From the perspective of Philipus M. Hadjon's Theory of Legal Protection, preventive and repressive legal protection has not been implemented optimally because there are no specific legal provisions governing protection mechanisms for elderly benefic iaries in accessing and receiving social assistance. Meanwhile, from the perspective of Richard M. Titmuss's Social Welfare Theory, the implementation of the Family Hope Program represents a form of state intervention to provide social protection and improve the welfare of the elderly. Nevertheless, these objectives have not been fully achieved due to persistent barriers preventing elderly beneficiaries from independently accessing and receiving social assistance. Therefore, it is necessary to improve Minister of Social Affairs Regulation Number 1 of 2018 through the reconstruction of provisions concerning the protection of access instruments for social assistance, distribution mechanisms for elderly beneficiaries who are unable to conduct banking transactions independently, and the strengthening of preventive and repressive legal protection through assistance, supervision, complaint mechanisms, and the handling of social assistance misuse to ensure that social assistance is received and fully utilized by elderly beneficiaries.
