Abstract
Abstract—The formulation of regional regulations (Peraturan Daerah/Perda) is not merely a formal legislative activity, but a democrati c process that determines the legitimacy, effectiveness, and fairness of local legal products. This article examines the urgency of public consultation stages in drafting regional regulations at the Regional People's Representative Council (DPRD) of Mojokerto City . The study is derived from juridical-empirical research using a case-study approach, with statutory, conceptual, and socio-legal analysis. The research focuses on the gap between formal compliance with the stages of regional lawmaking and the substantive quality of public part icipation. The findings show that public consultation in Mojokerto City tends to remain at the tokenism level in Arnstein's ladder of participation. Citizens may be heard, yet there is no adequate mechanism to ensure that their inputs are considered and explained in the final draft. This weakness is reflected in the resistance to the waste-service retribution arrangement under Regional Regulation No. 7 of 2023 and in the limited documentation of consultation minutes. The article argues that meaningful public consultation must begin at the planning stag e, continue during drafting and deliberation, and be supported by clear standards of representation, information access, documentation, a nd follow-up. Such consultation is urgent to ensure legal certainty, legal utility, and justice in regional regulation.
