Abstract

hild testimony often plays an important role in criminal proceedings, particularly in cases where children act as victims or witnesses. However, legal issues arise regarding the evidentiary value of child testimony given without an oath, as the Indonesian Criminal Procedure Code (KUHAP) generally requires witnesses to testify under oath. This study aims to analyze the legal position and evidentiary value of unsworn child testimony within the Indonesian criminal justice system. The research employs a normative legal method using statutory and conceptual approaches. Data were collected through library research by examining legislation, legal doctrines, books, journals, and other relevant legal materials. The findings indicate that, pursuant to Article 160 paragraph (3) of KUHAP, child testimony given without an oath does not qualify as valid witness testimony. Nevertheless, based on Article 171 and Article 188 of KUHAP, such testimony may be considered as indicative evidence (petunjuk) when supported by other lawful evidence and when it corresponds with the facts established during the trial. These findings demonstrate that unsworn child testimony continues to have evidentiary significance in criminal proceedings despite its limited legal status. Therefore, a consistent interpretation of relevant legal provisions is necessary to ensure legal certainty while maintaining the protection of children's rights within the criminal justice process
