Abstract
The growth of the insurance industry in Indonesia is suspected to be in line with the development of digital technology and telecommunications.Telemarketing is one of the marketing media that currently used by insurance companies. In practice,the telemarketing system has the potential to fulfill the element of undue influence. Moreover, if one party is in a frail position and the other party uses the situation as a benefit. The aim of this research is to analyze the existence of elements of undue influence in the insurance agreement through a telemarketing system. The research is normative study research or library research, which used a statute approach and a conceptual approach. The results of the study reveal that recording of conversation as evidence in the insurance agreement through a telemarketing system is very vulnerable to harming consumers and can fulfill the element of undue influence.
