Abstract
The case of Century Bank and PT. Antaboga Delta Sekuritas Indonesia in connection with the missing of deposit money belongs ti Century Bank’s customer which was invested on mutual fund product belongs to PT. Antaboga Delta Sekuritas Indonesia in the form of discretionary fund were started from the customers of PT. Century Bank who places their fund on Bank Century Deposit, then as suggested by Century Bank, the customers moved their deposits to mutual funds product of PT. Antaboga Delta Sekuritas Indonesia. However, until the due date, those customers could withdraw any of their money. Civil law construction has classified this case as an ignorance and an act against the law construction, therefore it may be sued into an failure claim as well as lawsuit of an act against the law towards Century Bank and PT. Antaboga Delta Sekuritas.
