Abstract
Transportation is one key elements in our daily life. It has become a very important thing because people use vehicles and transportation in order to take them to places in order to do their daily routines. Every element of thr society uses transportation in their activities. Republic of Indonesia has specific regulations concerning transportation, which is Law Number 22 Of 2009 concerning Road Traffic and Transportation. The philosophical base of the law is that road traffic and transportation have a strategic role in supporting the development and intergration of the nation as a part of an effort in improving public welfare. Law Number 22Of 2009 concerning Road Traffic and transportation also regulates accidents, the very common phenomena nowadays. One of them happened on Jalan Raya Perak Jombang. WB who used cellphones while riding a motorcycle caused a traffic accident resulting in a death victim. This research used a normative juridical method to find out whether WB could be hold responsibility for his action that resulted in the death of another person. This research uses the juridical normative method to find out whether WB can be requested liability due to his actions.
