Abstract

Banks provide financing to prospective home buyers in installments through KPR. Generally, KPR are provided with guaranteed rights imposed on land and building rights of KPR objects. In practice, because the house certificate has not completed the solving process or adapted to other conditions that cause the AJB has not been carried out before the PPAT, the developer binds prospective buyers with PPJB. PPJB is not a type of material guarantee, which gives preferential rights for creditors. PPJB only positions banks as concurrent creditors. If PPJB is used as a temporary basis for mortgage guarantees, the bank cannot claim its rights by unilaterally executing the mortgage object if the debtor makes bad loans. Legal protection can be taken by banks to obtain repayment guarantees due to debtor bad loans is to make a buyback guarantee agreement, where the developer as a guarantor of repayment of debtor debts if the debtor defaults.
