Abstract

HGB is the right to build and own buildings on land that is not owned, ownership of land rights is proven through certificates, the essence of providing this certificate is expected to provide legal certainty and open access to formal financial institutional capital. This research aims to analyze and describe the granting of building use right certificates on water based on utilitarianism theory. This research approach uses normative juridical method which is a research based on literature study which includes primary legal materials and also secondary legal materials. The results of this study reveal that the granting of HGB certificates over water is one form of realization of the purpose of law, namely expediency. This is in line with the concept of Utilitarianism theory “the greatest happiness of the greatest number” a good policy or action from an ethical point of view is a policy or action that brings the greatest benefit to society. However, the granting of HGB certificates to the Bajo tribe cannot be given immediately, but the government and the community must pay attention to the requirements for building buildings on water. Utilitarianism theory provides a concept of legal thinking that reviews how the purpose of the law itself is to provide as much benefit as possible.
