Abstract

This study aims to examine the effectiveness of diversion programs as an alternative to juvenile justice in cases of sexual violence, with a focus on mechanisms, obstacles, challenges, as well as restorative aspects or prevention of recidivism from perpetrators. This research uses a qualitative approach with a literature study method. Data were obtained from laws and regulations, journals, books, and articles related to diversion programs in cases of child sexual abuse. The results of this study indicate that the diversion program in Indonesia has not yet achieved optimal effectiveness. This is due to the lack of understanding of law enforcement officials regarding diversion regulations, limited resources and infrastructure, and the low level of trust and participation of the community due to the negative stigma attached to children in conflict with the law. As a result, the process of social reintegration of child offenders is hampered. This study recommends several steps to improve the effectiveness of diversion programs such as increasing the capacity of law enforcement officials, increasing public awareness, involving community leaders, developing online information platforms, and developing structured and sustainable post-diversion mentoring programs.
