Abstract
Despite hosting thousands of refugees for decades, Indonesia remains a non-party to the 1951 Refugee Convention and the 1967 Protocol. As a transit country, refugee management in Indonesia has primarily relied on administrative arrangements and humanitarian cooperation, often framed through durable solutions such as resettlement, voluntary repatriation, and local integration. This article argues that such approaches are legally and socially insufficient because they overlook the cultural and religious dimensions inherent in refugee communities and host societies. This study examines the legal and policy framework governing refugees in Indonesia and contends that the absence of an intercultural and interfaith perspective has contributed to persistent protection gaps, social exclusion, and policy stagnation. Using a normative legal approach complemented by socio-cultural analysis, the article analyzes Indonesian refugee governance within international human rights law and regional refugee discourse. The article further argues that interfaith and intercultural dialogue should be recognized not merely as a humanitarian initiative, but as a normative component of refugee protection in transit countries. Such an approach strengthens social cohesion, mitigates conflict, and enhances the realization of refugees’ fundamental rights, even in the absence of formal treaty ratification. By repositioning refugee protection within a broader legal–cultural framework, this article offers an alternative model for refugee governance in Southeast Asia that bridges legal obligations, social realities, and human dignity.
