Abstract

The government issued regulations through Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration on February 21, 2021. The government imposes restrictions on former customary landto be registered before 5 years from the regulation's enactment. The provision also explains the consequences of not registering former customary land outside of this period. The positivist legal theory is a legal theory that prioritizes legal certainty over other legal objectives including justice. The elimination of former customary land is an effort by the government to prioritize legal certainty. The many conflicts and land disputes are often also caused by overlapping customary land with external parties. The overlapping ownership creates a lack of certainty and legal guarantees for ownership rights. Thegovernment is also currently changing land certificates from physical to electronic certificatesin this technological developmentsera. This is done to avoid forgery and overlapping land ownership. In the perspective of the theory of legal positivism, the government cares and wants to resolve all disputes, as well as prevent disputes or conflicts. The regulation on the elimination of customary land in 2026 was made in order to create legal certainty for land owners. Keyword:Abolition, Customary Land, Positivism.
