Abstract

BSTRACTRestorative justice represents a new paradigm within modern legal systems that places the restoration of social relations and the moral responsibility of offenders at the center of justice, rather than mere punitive retaliation. This study aims to analyze the theoretical approaches and practical implementation of restorative justice within the contemporary legal framework, focusing on the transformation of legal values toward a more humane and socially just system. The research employs a normative-juridical and comparative approach by examining legal theories, statutory regulations, and their implementation across different jurisdictions. The findings reveal that restorative justice effectively reduces recidivism, enhances victim satisfaction, and strengthens social cohesion. Its implementation in Indonesia has begun to develop through several national policies, yet structural barriers, retributive legal culture, and institutional limitations remain significant challenges. This study emphasizes the need for systematic integration of restorative principles into the national legal system through regulatory reinforcement, institutional capacity building, and societal awareness to realize a substantive, participatory, and equitable model of justice for allKeywords: Restorative Justice, Modern Legal System, Social Restoration
