Abstract

This article examines the fragmentation of employment Social Security for civil servants in Indonesia after Constitutional Court Decisions No. 72/PUU-XVII/2019 and No. 6/PUU-XVIII/2020 annulled the transitional provision that required the transfer of civil servant old-age savings and pension programs to BPJS Ketenagakerjaan. The study aims to assess the coherence of the legal framework, the institutional implications of the dualism between BPJS Ketenagakerjaan and PT Taspen/PT Asabri, and the relevance of comparative Social Security reform in Southeast Asia. This normative legal research applies statutory, case, conceptual, and comparative approaches. The analysis shows that the post-decision framework creates legal disharmony, weakens institutional efficiency, and risks unequal protection among workers. Although the Court allows plural administrators, the social justice mandate of the Constitution still requires a coherent, accountable, and portable system. Therefore, regulatory harmonization is needed to place the basic employment Social Security programs within an integrated public-law framework while allowing legacy institutions to provide supplementary benefits during a gradual transition
